1. Submitting a Notice of Claimed Infringement

Clarity is a read-only personal-finance workspace; user-provided content is limited to materials you upload to your own account, such as document attachments and a profile image. If you believe such content available through the Clarity Service infringes your copyright, you may submit a written notification to Clarity's designated agent. A valid notice under 17 U.S.C. § 512(c)(3) must include all of the following:

  1. a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  2. identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notice, a representative list of such works at that site;
  3. identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Clarity to locate the material (e.g., the URL or in-app path);
  4. information reasonably sufficient to permit Clarity to contact you, such as an address, telephone number, and an electronic-mail address;
  5. a statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  6. a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Misrepresentations in a DMCA notice may subject the sender to liability for damages under 17 U.S.C. § 512(f).

2. Counter-Notice

If you believe your content was removed in error or as a result of misidentification, you may submit a counter-notice under 17 U.S.C. § 512(g) to the same designated agent. A valid counter-notice must include:

  1. your physical or electronic signature;
  2. identification of the material that has been removed or to which access has been disabled and the location at which it appeared before it was removed or disabled;
  3. a statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material; and
  4. your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located (or if outside the United States, any judicial district in which Clarity may be found) and that you will accept service of process from the person who provided the original notification or an agent of that person.

3. Repeat-Infringer Policy

Consistent with 17 U.S.C. § 512(i), Clarity maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. We may also disable access to content alleged to infringe and take other action we consider appropriate.
